You can never be 100% sure. Always use protection unless you are willing to take the risk of a lifetime of herpes.
If someone is a carrier of herpes and shows no symptoms, how do you know when they are contagious?
I would think you should always think that they are.
People can transmit herpes even if they don't have a sore. It's just not as likely as when they do.
